1. Acceptance of Terms

By downloading, installing, or using HeXaGoal (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a binding agreement between you and Roman Goltsov, an individual developer registered in Astana, Republic of Kazakhstan ("we", "us", "our", "the Operator"). Together with the Privacy Policy, they govern your use of the App.

You may also be subject to additional terms imposed by Apple Inc. (for iOS) or Google LLC (for Android) for the platform on which you run the App. Where those terms conflict with ours, the platform terms control for matters within the platform's scope (for example, refunds processed by Apple or Google).


2. Description of service

HeXaGoal is a mobile application that produces probabilistic predictions for football (soccer) matches. The predictions are generated by a backend system that combines:

The specific algorithms, model architecture, and feature engineering used to generate predictions are our proprietary trade secrets and are not disclosed in detail here or in any public-facing materials.

The predictions are estimates, not guarantees. They reflect statistical likelihoods based on historical data; the future is uncertain and any specific match can produce an outcome that the model considered improbable.

The App is NOT financial advice, betting advice, or a betting tool. We do not facilitate wagering. We do not partner with any sportsbook, bookmaker, or gambling operator. Any decision you make based on information shown in the App - including any decision involving real money - is your own decision, taken at your own risk. We disclaim liability for such decisions to the maximum extent permitted by law (see §9).


3. Account registration

To use most features of the App, you must create an account. You can create an account using:

You must be at least 13 years old (or 16 in the European Economic Area) to create an account. If you are below the applicable age threshold, do not create an account; if you have already done so, contact us to delete it.

We reserve the right to refuse, suspend, or terminate accounts that violate these Terms or that we reasonably suspect are fraudulent or automated.


4. Subscription terms

4.1 Tiers

The App offers two access tiers:

Anonymous (signed-out) browsing of a marketing-preview slice (top matches and headline predictions) is also available, but does not constitute a "tier" with rights - it is a free preview.

4.2 Pricing

Premium is offered at the following prices (US Dollars; local-currency equivalents are determined by Apple App Store and Google Play Store regional pricing tiers):

Apple takes a platform fee on auto-renewing subscriptions; under the Apple Small Business Program (for operators with under $1 million per year in proceeds), this fee is reduced to 15%. Google's fees are comparable.

We may change prices for new subscriptions; existing subscriptions continue at the price you originally agreed to until the next renewal, at which point the new price applies (subject to advance notice required by Apple or Google rules and applicable law).

4.3 Free trial

Premium Monthly and Premium Annual each include a 7-day free trial for first-time subscribers. Eligibility is enforced by Apple and Google: if you previously trialed any subscription in the same group on the same Apple ID or Google account, you are not eligible for a second trial.

If you do not cancel before the trial ends, your subscription auto-renews at the standard price for the chosen plan.

4.4 Auto-renewal

Premium Monthly and Premium Annual auto-renew at the end of each billing period unless you cancel at least 24 hours before the period ends.

4.5 Cancellation

Cancellation must be performed via your Apple ID or Google Account, NOT through the App. Apple and Google require this - we do not have the ability to cancel subscriptions on your behalf.

After cancellation, your access continues until the end of the period you already paid for, then ends.

4.6 Refunds

Refunds for App Store and Google Play purchases are governed by Apple's and Google's respective refund policies. Apple typically grants refunds via reportaproblem.apple.com; Google via play.google.com.

We do not directly process refunds because we never receive your payment - Apple or Google does. However, if Apple or Google issues a refund to you, we will be notified via Apple App Store Server Notifications or Google Real-Time Developer Notifications, and we will adjust your subscription state accordingly.

We may, at our sole discretion and for goodwill cases, contact Apple or Google on your behalf to support a refund request, but we have no obligation to do so and no power to compel either platform.

4.7 Grace periods and account hold

If your auto-renewal payment fails (for example, an expired card), Apple and Google provide a billing-grace period during which we keep your Premium access active. If the payment ultimately cannot be collected, your subscription moves to "account hold" and Premium access ends.

4.8 Family Sharing

Apple Family Sharing for the subscription products is OFF at launch. We may enable it in a future release; you will be notified if we do.

Google Play Family Library is not currently supported for these subscription products.

4.9 Service discontinuation

We do not promise the service will continue indefinitely. Events that could trigger discontinuation include - but are not limited to - loss of upstream data provider access, a change in legal status of the Operator, or a sustained inability to fund operations.

If the service is discontinued, subscribers will be notified at least 30 days in advance via the email address associated with their account. No new subscriptions will be sold once the discontinuation date is announced; auto-renewals will be turned off; existing subscriptions will run to the end of their current billing period without renewal. Pro-rata refunds for unused portions of the current billing period will be processed through Apple App Store or Google Play, subject to platform refund rules.

6. Intellectual property

We own - or have licensed - all rights, title, and interest in the App, the HeXaGoal brand, our proprietary prediction algorithms and statistical models (which constitute our confidential trade secrets), and the prediction outputs. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal non-commercial use.

You may not remove copyright, trademark, or other proprietary notices from any part of the App.

Football match data and statistics are sourced from licensed third-party data providers; their respective licenses cover that data.


7. User-generated content

The App does not currently accept user-generated content (no comments, reviews in-app, posts, or uploads). If we add user-content features in the future, additional terms will apply and we will update this section.


8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

We specifically disclaim:

Predictions are not financial advice, investment advice, or betting advice. The App is not a betting platform. We are independent of any sportsbook or gambling operator. Any decision you take based on information from the App is your own.

Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, the disclaimers above apply only to the maximum extent permitted by local law.


9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE GREATER OF:

WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LOST GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These limitations apply to the maximum extent permitted by law. Some jurisdictions (notably parts of the European Union) do not permit the exclusion or limitation of liability for certain damages - for users in those jurisdictions, our liability is limited to the minimum permitted by local law.


10. Termination

We may suspend or terminate your access to the App, with or without notice, if you breach these Terms, if we reasonably suspect fraud or abuse, if we are required to do so by law, or if we discontinue the service.

You may delete your account at any time by emailing support@hexagoal.app. Account deletion triggers data deletion per the Privacy Policy §6 (subject to our legal obligation to retain a subset, such as subscription receipts as required by applicable tax law - typically 5-7 years for financial records).

If your account is terminated, sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 11 (Governing Law), and 12 (Changes) survive.


11. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-laws rules. The courts of Astana, Republic of Kazakhstan have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the App.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws grant you the right to bring a dispute in your country of residence, this clause does not prevent you from exercising that right. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ where applicable.

For App Store and Google Play distribution disputes, Apple's and Google's respective dispute-resolution rules may apply to matters within their scope (for example, refund-related disputes).


12. Changes to these Terms

We may update these Terms. When we do, we will:

Your continued use of the App after the effective date of updated Terms constitutes acceptance of the updated Terms. If you do not accept the updated Terms, stop using the App and delete your account.
